Booking terms and conditions

BOOKING CONDITIONS FOR STONEHALL AND HOUSES (together and separately the “Property”)

CONTRACT OF HIRE:

The contract of hire is effective when we have sent written (which may be by email) confirmation of the booking on receipt of payment of the deposit (see below). The hiring contract confers upon the Hirer the right to occupy the Property for a holiday and/or reception only within the meaning of section 9 of the Rent Act 1977.

BOOKING DEPOSIT AND PAYMENT BALANCE

Bookings made more than eight weeks (56 days) before the date of arrival are confirmed on receipt of the deposit, which is calculated as one third of the total holiday price. The balance of the total price is then required not later than eight weeks prior to the date of arrival. We shall be entitled to treat any failure to pay such balance by the due date as a cancellation of the booking by the Hirer, and will notify the Hirer in writing (email) if we intend to do so.

When bookings are made 8 weeks or less before the intended date of arrival the whole of the holiday charge is payable at the time of the booking.

SECURITY DEPOSIT AGAINST DAMAGES

We require payment, not less than 8 days prior to the arrival date, of a Security Deposit against damage (accidental or otherwise) to the Property and/or contents.   Provided that the Property is handed back in the same condition as on arrival (fair wear and tear accepted) this Security Deposit will be refunded in full to the Hirer by us within 7 days of departure. The security deposit is intended to cover damage, accidental or otherwise, and unreasonable mess (including washing up left undone). 

The Security Deposit shall be £250 or 25% of the total holiday price whichever is the lesser. For larger parties (>10 people) we reserve the right to request £500 as a security deposit against inadvertent or deliberate damage. For receptions in The Great Hall we request a security deposit of £1000 to cover damage accidental or otherwise.

In the event that the Property or contents are found to have been materially damaged, then without prejudice to all our rights and remedies, including our right to seek full compensation for the damage from the Hirer, it is agreed that we may deduct all or part of the Security Deposit reflecting our bona fide estimate of the cost of making good the aforesaid damage.

PAYMENT

Hirers paying by credit or debit card over the telephone and/or by paypal or cheque shall be deemed to have read all booking conditions and agree to be bound by them. Please make cheques payable to Centaur Gallery Ltd. and write your name and address on the reverse of the cheque.

For your booking to be confirmed we must receive your deposit payment of the date when the provisional booking is made.

CONFIRMATION OF BOOKING

All charges as well as the amount of deposit are shown on the confirmation of booking. The deposit shall be treated as part payment of the total sum due for the holiday.  Once confirmation of booking is issued the Hirer is responsible for the total advertised price of the holiday and extras as shown on the confirmation of booking.  Upon receipt of a deposit we will issue a confirmation of booking showing the balance payable and the date by which it must be paid. 

ONLINE BOOKINGS

When you submit via our online system reservation system you will receive by email a booking summary.  This will be sent to the email address you provide in the booking form.  This does not form a contact between us.  A contract shall only arise when your booking is subsequently confirmed in writing by a letter of confirmation sent to you by post or email.

FINAL DETAILS AND TRAVEL DIRECTIONS

On receipt of your final payment we will send you details including a) directions to the Property and its address b) contact details for the Keyholder.

VAT

All prices quoted are based on current prices and VAT at the time of publication.  We guarantee to maintain basic prices for the period stated however we are unable to absorb increases in VAT or other taxes or local charges introduced after the date of a booking.  Any such increases will be charged as notified and will be payable by the Hirer.

BOOKING AMENDMENT

Once we have issued your confirmation of booking we regret that we are unable, save in exceptional circumstance and at our sole discretion, to change or alter bookings, when an additional administration charge of £50 may at our discretion be made.

Cancellations must be notified in writing to us, once a confirmation of booking has been issued the person making the booking is responsible for the total costs shown on the letter of confirmation of booking.   The deposit paid on the booking will be automatically forfeited.  If written notice of cancellation is received by us less than 8 clear weeks (56 days) before the holiday commencement date the Hirer will be liable to pay the appropriate cancellation charges shown below.

*in the event that we are able to relet the property, such monies will be refunded to you minus the administration fee.

PERSONAL BELONGINGS

Baggage and personal belongings are at the Hirers risk at all times.  No responsibility can be accepted for loss or damage to the personal belongings of the Hirer, including any car or contents parked near or on the Property, during the period of hire.

PARTY SIZE AND COMPOSITION

In no circumstances, unless agreed in writing by us prior to the arrival date, may the party size and composition exceed the figures below.

Bookings cannot be accepted from groups (i.e. more than two adults) of single persons under the age of 25 years accept at our absolute discretion.  In such circumstances a higher security deposit may be requested.   No stag parties permitted.  

Not more than six day visitors are permitted to the Property without our prior written consent, and again we reserve the right to refuse in our absolute discretion, and consent may be made subject to payment of a greater security deposit.  

We reserve the right to refuse admittance, and or terminate an occupancy of the Property, with forfeit of the total holiday price, if these condition is not strictly observed.  

* The Great Hall is for residential guests only.

We do not usually accept hen or stag parties but you are welcome to contact us about this and we do vary our terms on a case by case basis.

In all cases, please advise us if the Hall is to be used by non residential guests.

For a reception or other event, an additional charge is payable  (to cover public liability etc). The surcharge will depend on the number of guests.

NOISE AND NEIGHBOURLINESS

The Hirer undertakes not cause a nuisance to neighbouring properties or persons and shall take all reasonable endeavours to ensure that nothing done by the Hirer shall disturb the quiet enjoyment of the neighbours.  We reserve the right to terminate the hire of the Property in our absolute discretion, with forfeit of the total hire charge in the event of nuisance and breach of these provisions by the Hirer.  

MINORS

Bookings may only be made by adults and will not be accepted from persons under the age of 18.  

TAKEOVER RETURN AND LETTING PERIOD

All bookings commence at 4pm on the day of arrival and end at 10am on the day of departure (accept where otherwise agreed) and we reserve the right to levy an additional charge equivalent to a days hire of the Property if this is not observed without prior arrangement.  

HIRERES RESPONSIBILITIES

The Hirer is responsible for the Property and agreed to take all reasonable care of it and its contents.  All equipment, utensils etc must be left clean, and the Property must be left clean and tidy at the end of the hire period.  If the Property is left in an unsatisfactory condition and additional cleaning costs are incurred we reserve the right to recover these costs from the Hirer, including to deduct all or part of the Security Deposit.  

All breakages and damage must be reported to the Housekeeper immediately so that they can be rectified.   All breakages and damage are the legal responsibility of the Hirer and the cost of repair or replacement shall be refundable to us upon demand.

OUR RIGHTS

We reserve the right, at our absolute discretion, to refuse any booking, or to cancel any booking if we determine it to be necessary or appropriate to do so.  Where we cancel a booking we will return, within 7 days of the cancellation, all deposits and all other sums paid by the Hirer.   In the event of such cancellation our liability for direct and indirect loss, damage and/or disappointment shall be limited to the return of the sums paid by the Hirer ,and it is agreed we shall have no further liability whatsoever.

INFORMATION

We have made every effort has been made to ensure that the information set out on our web site, or otherwise provided to the Hirer by us, is accurate, neither that information, nor any oral representations made by us, will give rise to any liability on our part if they are inaccurate.

COMPLAINTS

Any complaints concerning the Property or its equipment or facilities must be notified to the Housekeeper/Keyholder and us immediately so that any necessary action can be taken.

GENERAL

There shall be no liability for any claim arising from the act, omission or neglect or default by us unless proved to be done with intent to cause damage or recklessly or with knowledge that loss or danger would probably result.

RIGHT OF ENTRY

The right of entry to the Property at all reasonable times, with or without workman, for the purposes of inspection and/or repair to the Property or facilities or equipment, is reserved by us.  We will make all reasonable endeavours to provide prior notice to the Hirer where possible.

LEGAL

All disputes and differences shall be governed by English law and the jurisdiction of the English Courts.  All contracts made with the Hirer shall be governed by English law.
